Terms And Conditions

Client Contract

I, Emma Stott, am registered as data controller and processor with the Information Commissioner’s Office (ICO) and I endeavour to abide by their guidelines.

In 2021 the provisions of the UK-GDPR came into force.  This policy tells you what personal data I hold about you, why I hold it, and what your rights are. It will be updated in line with current legislation.

When you first contact me, I will collect your 1) Name 2) Email address 3) Telephone number and 4) any information you choose to supply regarding the purpose of your enquiry.   I use this information in order to make contact with you, and to provide you with the best possible treatment options, support and advice.

ONGOING TREATMENT

I will hold personal data related to and not limited to your name, contact details, date of birth, GP and next-of-kin details, and general medical information. This data will be collected and stored securely in line with ICO guidelines, when you sign a Client Form and Contract, and receive a copy of this policy at our first appointment.  

During treatment I will keep notes recording the progress of therapy with the intention of providing a consistent, effective and ethical service, either face-to-face, by telephone or via zoom. Session notes will be held securely according to ICO and my professional body’s requirements. 

 

THIRD PARTIES

I will not share your data with anyone else, except where there is good reason to believe that not to disclose certain information would cause harm to the client, to me (as the therapist) or to others. Information may have to be disclosed without consent for the prevention, detection, or prosecution of a crime and I cannot withhold information requested by Court Order.

 

Your Rights under the General Data Protection Regulations

The right to be informed (how your data is held and used – contained in this document).

The right of access (to your data, so you know what is held about you).  If you wish to see your data, please make a request in writing to me. This will be provided within 30 days of your request).                                         

The right to rectification (your right to request changes to information held about you if you believe it to be inaccurate. Should this be the case, please let me know as soon as possible).

The right to erasure (also called ‘the right to be forgotten.’  Given the nature of our work, I am required by my professional body to hold your data for a period of eight years, after which your data will be securely destroyed).

The right to restrict processing (I will only use your information as outlined in this policy).

The right to data portability (if you ask me to transfer your data to another clinician, I will do so. I will not share your information without your specific consent, other than in the situations described in ‘Third Parties’).

The right to object (to me using your personal data for any particular purpose).

The right not to be subject to automated decision-making and profiling.

The right to lodge a complaint (with the ICO, if you feel your details are not correct, not being used in the way you have permitted, or if they are being stored unnecessarily).

I take your data privacy seriously and use your personal information to contact you by telephone or email, concerning appointments and payment, and to provide the service you have requested from me. I do not share your data with Third Parties, with the exceptions outlined above.

I have put in place technical, physical and managerial procedures to safeguard and secure your information.

You do not have to consent to the collection and use of your personal data as outlined above, however, if you choose not to provide it, I may not be able to work with you.

CANCELLATION

Please give 48 hours’ notice if you need to cancel an appointment. If appointments are repeatedly missed, the therapist reserves the right to discontinue sessions.

CONFIDENTIALITY

Confidentiality is an integral part of psychological therapy and support. All communication taking place during therapy sessions is confidential, subject to certain provisions:

- All therapists have supervision with an experienced practitioner where each case is discussed. This ensures that you receive the best support. Supervisors are bound by confidentiality terms. If intervention or referral are deemed useful, then your details may be shared with the supervisor, with your knowledge.

SAFEGUARDING

If there is serious risk of harm to you or someone else then confidentiality may need to be broken to contact the relevant agencies (Your GP, Social Services, Police) – this will be discussed with you beforehand when possible.

Safeguarding Policy and working with children & Young People

Safeguarding means protecting the health, wellbeing and human rights of vulnerable people, supporting them to live as free as possible from harm, abuse and neglect.

Safeguarding young people and promoting their welfare means:

§  Protecting them from maltreatment, abuse and neglect or things that are bad for their health or development.

§  Supporting them in having a place to grow up, which provides safe and effective care.

§  Keeping what is said in our sessions private, unless a child/young person is in immediate danger, when they will be included in the decision about what we do next. (age appropriate)

§  Ensuring the child/young person and their parent and caregiver understand the processes of coaching and EFT (Emotional Freedom Techniques), its intended purpose and its limitations.

§  Ensuring that a child/young person is not treated as a small adult, because a young person has additional needs.

§  I am an LGBTQ positive practitioner.

§  I welcome you, whatever your ethnicity, neurodivergence or background.

GUARANTEES

There are a number of complex factors influencing the success of individual session work and, whilst benefits are typically observed in the majority of cases, results vary between individual clients and there can be no guarantees of cure or success in relation to an issue or its treatment. We cannot provide medical advice or medical diagnosis. You are responsible for contacting your GP or other medical professional for medical advice and before making any changes to your medical treatment.

DRUGS & ALCOHOL

Please do not attend sessions under the influence of recreational drugs or alcohol as these can numb or alter emotions and reduce the effectiveness of therapy.

​

CONTACT BETWEEN SESSIONS

To maintain appropriate therapeutic boundaries, contact between sessions will be limited to arrangements for session dates and times unless otherwise agreed between us.
